Welcome to TheTravelEnterprises.com (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website, mobile application, software-as-a-service platform, and all related tools and services (collectively, the “Platform”). By accessing or using the Platform, you (“User,” “Guest,” “Owner,” or “Client”) agree to be bound by these Terms.

These Terms are structured similarly to Airbnb’s Terms of Service but are customized for Travel Enterprises LLC and its service model as a listing, advertising, and SaaS provider.

1. Overview of Services

1.1 Platform Purpose – The Platform allows property Owners to list properties for rent, advertise availability, receive leads, and connect with Guests seeking vacation rental opportunities.

1.2 No Brokerage or Real Estate Services – We are not a real estate broker, travel agency, or property management company. We provide marketing, advertising, and SaaS tools only.

1.3 Third-Party Integrations – Our Platform uses third-party tools including Google Ads, Meta Ads, email distribution systems, and analytics providers.

1.4 Independent Relationships – We do not own, manage, or control properties listed on the Platform. All arrangements between Guests and Owners are strictly between the parties.

2. Account Registration and Responsibilities

2.1 Users must create an account to access Platform features.

2.2 Owners are responsible for providing accurate and complete property information.

2.3 Users agree not to share login credentials and to maintain account confidentiality.

2.4 Owners acknowledge that a unique login grants access to their advertising and SaaS dashboard.

2.5 Company reserves the right to suspend or terminate accounts for violations of these Terms.

3. Owner Listing Terms

3.1 Owners may list properties in accordance with the Subscription Agreement.

3.2 Owners certify they have the legal right to rent or advertise the property they list.

3.3 Owners grant Company the right to use property information, photos, and details for advertising.

3.4 Leads and inquiries generated by marketing campaigns are forwarded directly to Owners.

3.5 All negotiations, pricing, bookings, and property transactions are strictly between the Owner and Guest.

3.6 Owners agree to indemnify Company from disputes, damages, or claims arising from property listings.

4. Guest Responsibilities

4.1 Guests are responsible for verifying property details and negotiating directly with Owners.

4.2 Company does not guarantee pricing, availability, accuracy, or booking outcomes.

4.3 Guests agree not to misuse the Platform or attempt to circumvent communication channels.

5. Payments, Fees, and Subscriptions

5.1 Subscription Fees for Owners are paid as outlined in their Listing Agreement.

5.2 All fees are non-refundable once services are rendered, including when:

  • Leads are delivered
  • Owner receives inquiries
  • Owner accesses their SaaS dashboard or mobile application

5.3 Guests do not pay the Company directly unless using optional premium features.

5.4 Chargebacks, disputes, or fraudulent claims may result in account termination.

6. Cancellations and Refund Policy

6.1 Owners may cancel within 3 days of signing their Listing Agreement and may receive a refund as stated therein.

6.2 After mobile app access or lead generation begins, refunds are waived.

6.3 Guests must contact Owners directly for booking cancellations.

7. Content and Intellectual Property

7.1 All Platform content—including software, branding, logos, and digital systems—is owned by the Company.

7.2 Users may not copy, distribute, modify, or reverse engineer any Platform materials.

7.3 Property photos and descriptions submitted by Owners grant Company a royalty-free license for marketing.

8. Prohibited Activities

  • Upload false, deceptive, or illegal content
  • Bypass Platform systems or attempt to collect data improperly
  • Use the Platform for unlawful, discriminatory, or fraudulent purposes
  • Interfere with Platform performance or security

9. Third-Party Services and Links

9.1 The Platform may contain links to third-party websites or integrations.

9.2 Company is not responsible for third-party content, privacy practices, or service performance.

10. Mobile Application Access

10.1 Access to the mobile app is included with the Owner’s subscription.

10.2 Services are considered fully delivered when the Owner successfully logs into the mobile app.

10.3 Upon login, Owner waives rights to cancellations, refunds, or chargebacks.

11. Disclaimer of Warranties

11.1 Platform is provided “as-is” without warranties of any kind.

11.2 Company does not guarantee any specific number of leads, bookings, or revenue outcomes.

11.3 Marketing performance varies based on market conditions, property details, pricing, and Owner engagement.

12. Limitation of Liability

  • Property disputes
  • Cancellations or failed transactions
  • Loss of data or business
  • Damages arising from interactions between Guests and Owners

12.2 Total liability is limited to the amount paid by the User for services in the preceding 12 months.

13. Indemnification

Users agree to indemnify and hold harmless the Company from claims, disputes, damages, or liabilities arising from their use of the Platform.

14. Privacy Policy

Our Privacy Policy governs how we collect, use, and store user information.

15. Governing Law and Dispute Resolution

15.1 These Terms are governed by Florida law.

15.2 Any disputes will be resolved through mediation and, if necessary, binding arbitration.

16. Modifications to These Terms

Company may update these Terms at any time. Continued use of the Platform signifies acceptance of updated Terms.

We may share data with service providers, advertisement platforms, analytics tools, and legal authorities when required. We do not sell personal data.

4. Data Security

We use encryption, secure servers, and industry-standard practices, but no system is fully secure.

5. Cookies

We use cookies for authentication, analytics, personalization, and advertising.

6. Data Retention

We retain information as long as necessary to support accounts and comply with the law.

7. User Rights

3. Fees & Payments Policy

1. Owner Subscription Fees

Owners pay a one-time Subscription Fee for a 180-day listing. Fee covers advertising, lead generation, email blasts, and SaaS dashboard access. No recurring charges unless purchasing add-ons.

2. Refund Policy

Refunds apply only during the 3-day cancellation window. No refunds after:

  • Leads are generated,
  • Owner receives inquiries,
  • Owner logs into the mobile application.

3. Chargebacks

Chargebacks may result in account suspension.

4. Guest Payments

Guests do not pay the Company directly.

5. Taxes

Owners are responsible for determining applicable tax obligations.

4. Guest Booking Terms

1. Guest Responsibilities

Guests must verify property details, communicate honestly, and follow Owner terms.

2. No Guarantees

Company is not responsible for accuracy, pricing, availability, or cancellations.

3. Payments

Payments occur directly with the Owner.

4. Disputes

All disputes are between Guest and Owner.

5. Trust & Safety Policy

1. Platform Integrity

Users must provide truthful information and avoid fraudulent activity.

2. Fraud Prevention

We monitor and take action against suspicious behavior.

3. Safety Limitations

We do not verify properties or guarantee listings; users must conduct due diligence.

6. Content Policy

1. Allowed Content

Property photos, descriptions, pricing, and availability.

2. Prohibited Content

  • Misleading or false content
  • Offensive or discriminatory material
  • Copyrighted content without permission

3. License Granted

Owners grant Company a royalty-free license to use content for marketing.

7. Cancellation Policy

1. Owner Cancellation

Owners may cancel within 3 days of signing the agreement.

2. Guest Cancellation

Handled between Guest and Owner directly.

3. Company Cancellation

We may suspend accounts for Terms violations.

8. Hosting & Listing Standards

1. Listing Accuracy

Owners must maintain accurate listings, photos, and availability.

2. Communication

Owners must respond promptly to leads.

3. Compliance

Owners must follow local laws and HOA rules.

4. Removal of Listings

We may remove listings that violate policies.

10. Community Standards

1. Respectful Conduct

Users must communicate professionally.

2. Honest Representation

Property details must be truthful.

3. Zero Tolerance

No harassment, threats, fraud, or hate speech.

Results depend on market demand, seasons, competition, property quality, Owner responsiveness.

Owner Responsibilities

Owners must follow best practices to maximize results.

15. Guest Verification Policy

Verification Methods

Email verification, phone verification, IP screening.

Limitations

We do not conduct background checks.

User Responsibility

Both parties must verify each other's legitimacy.

16. Advertiser Disclosure Statement

Nature of Service

We advertise property listings; we do not manage bookings or payments.

Compensation

Owners pay subscription fees for advertising services.
